Research on the Current Status and Countermeasures of Geographical Indication Protection of Genuine Medicinal Materials in Yunnan Province

摘要

摘要: 地理标志作为知识产权制度的重要内容之一, 在道地药材知识产权保护过程中发挥重要作用。通过对云南省道地药材地理标志保护现状进行分析发现, 云南省在道地药材地理标志保护过程中, 存在确权机制待完善、监管职权归口混乱、立法保护体系不健全、侵权救济制度不完善、信息平台建设待加强和品牌建设规划不全面等问题。为提升云南省道地药材地理标志保护水平, 建议从完善地理标志确权机制、优化归口部门管理职能、推动地方立法保护体系建设、健全侵权救济体系、加快信息平台建设和加强地理标志品牌建设等方面加以改进，以推动云南中药材产业长期健康发展。

Abstract: As an important part of the intellectual property system, Geographical Indication plays an important role in the process of intellectual property protection of Genuine Medicinal Materials. In order to verify the protection effect of Geographical Indication and promote the realization of the strategic goal of building Yunnan Province into the largest Genuine Medicinal Materials center in China, the current situation of the protection of Geographical Indication of Genuine Medicinal Materials in Yunnan Province was studied and analyzed. The author found that in the process of protecting the Geographical Indication of Genuine Medicinal Materials in Yunnan Province, there are still some problems, such as the right confirmation mechanism to be improved, the supervision authority to be chaotic, the legislative protection system is not sound, the infringement relief system to be not perfect, the information platform construction to be strengthened and the brand building planning is not comprehensive. In order to improve the protection level of Geographical Indication of Genuine Medicinal Materials in Yunnan Province, the author suggests that the improvement should be made from improving the right confirmation mechanism of Geographical Indication, optimizing the management functions of centralized departments, promoting the construction of local legislative protection system, perfecting the rights protection assistance and relief system, speeding up the construction of information platform and strengthening the construction of Geographical Indication brand.
